Legal Question in Consumer Law in India

i had booked a property in a builders project by paying a booking amount. At the time of booking, builder verbally assured that everybody will get the unit and he has enough land reserve as there was rumors that he has done overbooking for the said project. I opt for the construction link plan. after 90 days of booking builder asked for the second installment and i payed it within due time. then he make the draw and allocate the approved no of units which he was having in his hand. then after 150 days of booking he asked for the third installment and told us that who will pay the 3rd installment units will be allocate to them in next allottment. i pay the same within due time. After that he made the second allottment but i didnt got the unit and with me so many also didnt got the unit. Now approx two yrs has passed since booking. on asking from builder, he is saying that unit will be alloated in the next allottment but he can not confirm the time frame as it may take years. Now he is suggesting that either one can switch to some other project of his ( if i will switch in other project, he will charge the present rates of property) whereas there is big difference in present rates and two years before rates. Second option he is giving that he can refund the money with the 9% intrest rate if i will agree and sign some documents. Please guide me that what all legal action can i take against the builder as neither he is denying that he will not alloat nor he is confirming the time frame of next alloatment. please guide me what should i do.

you may approach the consumer court against the builder for redressal of your grievances.
