Legal Question in Consumer Law in India
dear sir,
we have booked 4 flats in a under construction project in nirmal lifestyles,mulund,mumbai in the year 2007.
we also registered the agreements and paid the approrite stamp duty.
the project got struck due to forest land issue for 2 to 3 years.
the project was then cleared and the construction started from last 3 to 4 months.
meanwhile in 2007 i had applied for a loan from obc bank and i have also submitted the sanction letters to the builder and have obtained his noc for mortgage of the flats.
the bank was asking for approved plan copy of the project but the builder is not in a position to give the same and therefore the loan could not be disbursed,
the builder now is asking for 45percent money and has given me a notice that they have cancelled our flats and they are now free to sell it to anybody else.
before this notice i have not received any demand notes or any notice from the builder.
i therefore would like to know as to what legal action i can take against the builder.
secondly,the project is of 30 storey and he has completed only 5 floors podium parking slabs and 1 floor residential building slab.so i would like to know as to how much amount can he demand from me according to law.

you may approach the consumer court and file a complaint against the builder.
