Legal Question in Consumer Law in India
I Dinesh Kumar ,is having a flat in Center Government Employee Welfare Housing Organization Scheme (CGEWHO, Mohali) . the draw for the scheme was held in march 2007 for which the amount decided by the organization was Rs 23 lakh for 1250 sq ft , later they increased the area to 1320 sq ft and increased the cost to Rs 25,lakh i accepted their terms and conditions. the construction was expected to start in mid 2007 on approval of plans by statutory authority, but it started in mid 2008, the reason given by the organization was delay due to per-constructional activities such as topographical surveys, soil investigations, preparation of detailed working drawings, specifications, site offices, cement godown, etc. however if we count from that date also the work should have been completed till january 2011. but now the organization is asking for 25% escalation money, for which they are giving reasons due to rise in price of steel, labour etc. and also athey are saying that the project is expected to be completed by march 2012. i want to ask can i go to consumer court in this case as we are being harassed by the company. the installments given by us were

5th installment------ may, 2010

Check terms of agreement for escalation as also for timely completion of project alongwith provisions of local law governing construction and sale of flats/units and act accordingly.
