Legal Question in Consumer Law in India

I lived in Building at Thane. Taken possession in May 2009. Builder is charging Rs. 2 per Sq. ft. as maintenance. But the amenities are not upto the mark and some are not available also. We the members formed a committee and some of members stop paying monthly maintenance charges to Builder. Last week, we had talk with builder and he asked to take care of the building maintenance till the society formation. As the OC is not available (there is case going on the un-completed building No. 7) He is demanding a letter stating that, the members will look after the society maintenance and the committee will collect the maintenance charges as routine.

Kindly guide us for the above issue. Can we give such things in writing? And builder has also not paid the property tax because assessment is not done by TMC, what we should do?
