Legal Question in Consumer Law in India
I have purchased flat in Thane, MH-India and as per agreement possession was due by Feb-2010 end. It was booked in Sep-09 and at the time of booking builder mentioned he would hand over the possession by Dec-09. Agreement was registered in mid-Nov-2009. When asked for possession, he agreed to handover by mid-Mar and accepted all one-time possession charges and bal bank disbursement. Now he mentioned that he cannot handover upto Mid-may and upon asking letter with date of possession to be mentioned, he has also charged me with interest and mentioned for some MSEB delays etc..he will be able to give possession by mid-May. There was never a delay from our end and upon personally chasing up and getting documents that he always delayed in providing, the demanded amount was paid out by 1st week of Jan within 1 week of final documents he submitted to
bank. to curiosity, can builder charge any interest from time of booking or providing official letter of offer with allotment that he provided almost after 6 weeks of booking.
