Legal Question in Consumer Law in India
Thanks for your reply sir. I want to sell my flat . The builder is charging a very high transfer fee.The society is in the process of registering, a chief promoter has been appointed and bank account has been opened in societies name. The committee is in the process of taking signatures from flat owners. No conveyence deed is availed on societyt. Is legally the builder allowed to charge such high amounts from sellers where society is not formed. An early answer is appreciated as we have already taken token money from buyer.

The terms of your contract will govern the matter.
Yes in that case the society has no legal entity and therefore builder or previous owner can collect the transfer fees
you may approach the consumer court in this matter for redressal of your grievances.
