Legal Question in Consumer Law in India
Salary account and corporate bullies
Hi,
First of all, I would like to know if a salary account as termed by corporate people is compulsory to accept a bank that they have tied up with. My understanding is that whichever bank account I wish to receive my salary by my employer is termed as salary account.
Again regarding the above, if the bank that my salary is going to is withdrawing the salary as soon as it comes to my account for a loan or other purposes and leaving the balance, are they allowed to manipulate and touch my salary without my approval. Because, I am forced to open a salary account when I join the company with the bank that they have tied up and I am not allowed to receive the salary in another bank account which I have.
Regarding the above, I didn't want my salary to be taken by the bank, so I asked my employer to issue a cheque other than the above bank which I wanted to deposit in my other bank account and would give a revenue stamped receipt, they plain denied it stating that the salary will go only to the account that we have tied up with.
Also, I have resigned from the company and they say you have to give one month's notice or else one month's salary will be deducted. Again, if I serve the one month, my salary will be taken by bank

You may not be allowed to avoid your responsibility under the garb of 'freedom'. You may be free to choose your bank; If you do not want to deal with the employer's bank, you may open a separate account somewhere else and transfer the money from employer's bank to the bank where maintain an account. But if you have obtained loan from employer's bank, that bank will be entitled to immediately deduct their dues towards "loans or other purposes". If you have resigned without notice and the contract required a notice, they may be entitled to salary in lieu of notice.
