Legal Question in Consumer Law in India
sameer admitted his infant son in a private nursing home.As a result of strong does of medicine administered by a nursing attendent, the child become mentally retarded.Sameer wants to make a complaint under Consumer Protection Act seeking relief by way of compensation on the ground that there was deficiency in service by the nursing home.Does his complaint give rise to a consumer dispute?Who is the consumer in this

first of all I am very sad for the kid.
the kid since can not represent himself therefore the guardian shall be the consumer. the parents can file the consumer case as well as civil case for damages. besides all this you can complain this to police and get the FIR registered against them.
that may come under criminal negligence but fr that u requires a report from the doctor .than only your f.i.r can get registered .
rest u can rightfully go to the consumer forum rather u must ...
