Legal Question in Consumer Law in India
I stay on the 6th floor. Our ceiling in hall, kitchen and bathroom is leaking. The person staying above our flat is a tenant and the flat owner refuses to conduct repairs to stop leakage, what is the legal course of action?

Dear Sir / Madam,
It is clearly evident that the leakage is from the top floor and it is the duty of the member residing above your flat to get it repaired. You should write a letter to the Secretary of your Society to intervene and ask the above member to carry out the repairs failing which, the matter should be reported to the Registrar of Co-operative Housing Societies for action.

Common area - between the two flats - needs repairs. If the member above is not doing Complaint with your Society, who needs to initiate action against the erring member.
