Legal Question in Credit and Debt Law in India

In 2002, I was using a credit card of ICICI Bank Delhi and I was regular to pay actual amount as well as sometimes minimum amount but the Interest was multipled They were asking Rs 30000/= to settle down the credit card Acount. Unfortunately I rush to home town because of problems in the family. After 8 years I came back to delhi. everything goes O.K. but one day I was getting call from

ICICI BANK on my Mobile .asking for Rs 70000/ the person is calling me, he himself introducing

that he is a lawyer and working in civil law Deptt of ICICI Bank, S D Tower, Sector -8, Rohini.till now no court proceedings are there. my question is after 8 years, can a person be arrested for non payment. If it is there then what precautioary step I have to take to avoid arrest. kindly guide me.

the limitation period to file a civil suit for recovery is three years. There is no question of any arrest in such matters.

However:

1. If you had issued a cheque, and

2. It got dishonoured, and

3. Bank issued a notice, and

4, Bank filed a criminal complaint, and

5. case had being hanging in the court, and

6. You were informed about the case. and

7. You received the information of the case

Then and then alone there is possibility of arrest otherwise not. If one of the seven condition is not there, nothing can be done.

Some one could be faking also.
