In the case of proprietorship if the proprietor lodge case against the party in the court after 5 months proprietor had expired. The case was filed by her husband who held power of attorney. Now the proprietorship in the name of husband . Can the husband demand for the return cheque amount?

Yes, husband, who is the proprietor now, may move an application for substitution as right to sue survived upon him.
