Legal Question in Credit and Debt Law in India
Can a Co-Borrower file appeal in the DRT-1 under Section 17
of the Securitisation and Reconstruction of Financial Assets and enforcement of Security Interest Act, 2002 (hereafter referred to as
the Securitisation Act‟)
against Borrower besides bank from which Home loan is taken and bank has issued a notice for full repayment on the plea that Co-borrower is dependent on borrower.
What is a repayment liability of Borrower for Bank Loan when House Property was Registered in Wife's name and she was Co-Borrower with Husband(Borrower) and was shown dependent while taking Loan and has entangled her Husband in Legal case by filing Domestic Violence case 2005(Still pending) and thrown her husband from the house mentioned above. The House was mortgaged to bank as security.
Thanks
