Dishonour of Cheque

Cheque issued as token advance for a land without any legally enforceable contract. After issue of cheque, decided not to go ahead with the deal and stopped payment. Complainant (land owner ) filed a case u/s 138 NIA after serving legal notice. Is this case sustainable?

it depends on various factors

case as such should not be sustainable but a wwell made case can be a problem

i need to see the notice to advice you properly

take help of any local lawyer otherwise
