Legal Question in Credit and Debt Law in India

I am being harassed by HSBC.

a) When I was using credit card (issued by HSBC), their was a fraud to the tune of around 80k for which I filed police complaint and the complete amount was reverted back.

Also bank charged interest on the original amount (80k). I told bank that they have reversed original amount then they should revert the interest also.

Now few years later they sent a summon to appear before lok adalat (Bangalore). What options I have (I don't want to pay any money, because I feel I don't owe them anything. I had cleared all dues (except the interest on reversed amount). I have police FIR copy, statement from HSBC where they reversed all charges.(what is legally correct, do I owe them or don't I?)

b) Also is there a way to sue bank in this case for harassment and to what extent. What are the resources required in this case (time, money and my liability if I sue bank for harassment). Please advise.

Thank you.

You have a good case for claiming damages to compensate you for all the harrasment. You may file your counter claim in the same court where the bank has filed and sent you summons. You should obtain certified copies of all the relevant documents like FIR, HSBC Statement etc. You are not liable to pay anything in the given situation.
