Harrasment by credit card company

On Nov27,08, i got 5 sms on my mob about 5 paymts made using my card. All 5paymts, total 23000were made to a same party.I was shockd asi did not do any paymts &i have no relation with the party to whom paymts were made.On calling cust care,they told that paymts were made thro internet &advised me to fax a dispute letter to the card issuing bank along with service request number they alloted to this complaint.They assured that the dispute will be resolvd in 1 month & i need not send any cheque till dispute is solvd.Since i did not getany response even after 1month,i again called the cust cell to update me about the status of the dispute.They told they have not recvd any fax and asked me refax the same dispute letter. Again 15 days after refaxing, they told they have not recevd any fax.They told perhaps their fax section being overloaded may be the reason and gave me another fax number this time.I again faxed to both old and new numbers. Again on calling after after some days they told they haven't recd any fax and gave me one more new fax number.So far i have faxed 6-7 times, but no avail.But i get paymt/overdue remindrs.They send home collection agents.Can i file legal proceedng &claim compensn for harrasment.WhatProofs do i need

You have not taken 'adequate' precautions in getting your complaint registered with the card issuing company/bank.

You may make an effort for claiming damages / compensation and to avoid your liability from payment of the card dues by filing a complaint before the Consumer Forum of your area.

Meet the concerned banking Ombudsman who serves under the guidance of RBI and settle your dispute before his court,with all your documentary evidence of the conversation and other versions that took place between you and the customer care of your credit card bank.
