Legal Question in Credit and Debt Law in India
Hi,
I had a credit card. I changed location after which I had no correspondence with the Bank. This was 5 years back. I had called customer care to find out outstanding amount and did not get proper answer, I heard from customer care that the card was closed. Apparently there was some outstanding amount, which was moved to recovery department. They sent notices to my office address in pune, which I did not get because I had moved to bangalore. They proceeded to file a criminal case against me in Patiala lok adalat and forwarded the case to police. I was unaware of all these proceedings. Now in the last week, One day police calls me with non bailable arrest warrant. I had to pay 60%(40000) of the outstanding upfront in 2 hours for their lawyer to withdraw the case against me. Now, I have never refused to pay the money I owed. I called them personally to find out the outstanding for which I did not get a proper response. Can such action be taken against me? Is there a possibility I can recover part of the money? I have paid more than what I owed. (I don't even know how much I had outstanding originally) I am trying to get statements from the Card company. What recourse do I have? Please advise.

You have to issue a lawyer notice to determine the outstanding and whether there is any case of the Lok Adalat.
