hi,

I owed amount of 1 lakh rupees from my friend and in turn i have given post dated cheque.

But due to the personal problems, i'm unable to pay the money. my friend is telling that he will give the cheque in the bank. I'm sure that amount will be dishounoured due to the insufficient funds.Please let me know how to solve the problem. I really can't pay money to him due to my personal problems.If he files a case against me, what should i do? Is there any way i can come out of this situation without paying money to him.

Hi,

the first thing to do is to come out of the Cheque Bounce problem.

Send a letter to your friend saying that you do not have insufficient funds in your bank , so kinldy dont present the cheques in the bank now and mention your problem. Make it sure the letter eaches your fiend and you get the receipt of the same. that can be done registered post, coourier etc.. send it by atleast two modes so that he can not deny the receipt of such letter in fututre.

If he sends a legal notice after presenting the cheque, then do reply the same.

All these things would help you in fututre course of action.
