Legal Question in Credit and Debt Law in India
Legal action after re-payment of a bounced cheque
I have a credit card from ICICI. In Octor 2006 I issued a cheque which bounced on 30/10/2006. Bank issued a legal notice which I received on 22/11/06. I just paid through another cheque which got cleared on 11/12/06. I did not take any other action. Now bank has filed case under 138. What is my defence ?

- you are not liable to pay the amount - should be your defence.
- contanct the bank - customer cell/legal personnel- even the bank ombudsman and give a letter in writing of your case and tell him that you are not liable to pay and that by such undue gains the bank has committed an offence! you may ask them to compensate later!
consult a lawyer!
