Legal Question in Credit and Debt Law in India

I am a native of Delhi. I live in Delhi and works in Gurgaon.

I am barely earning to be able to meet both ends.

A few years ago, i used to live in Bangalore and used to work there but my family (my mother, wife, and kids) used to live in Delhi. As it was not possibile for me to be able to live in Bangalore for a long time as my family was in Delhi. And due to some personnel reasons, my family was not in a position to come to bangalore.

As i was planning to come back to New Dehi, i thought of starting a business so that i can take care of my family and also be able to return to Delhi.

I took a few personnel loans from Banks and also on my credit cards. Unfortunately, the business went down due to my inexperience. And i had to quit the job and return to Delhi as well.I was jobless for some time and than i got this job in convergys.

Unfortunately, due to the business getting flopped and due to my income shrinking, i was not able to pay my EMIs on my Credit Card and also on my bank loans. Now for last few months the collection agents have been harassing me and my family by visiting us and making scenes all the time. And now it appears to me that they have in fact gone to the extent of extracting my mobile phone records from the mobile company and have taken the number of my relatives, friends, and other contacts and have started to call them.

I am not denying that i should and i will be paying my dues. However, I am still not in a position to be able to pay them for a few more months as my financial condition is still not improved. Is there any way i can stop this harrassment ?

this conduct of banks is illegal. they cannot call your relatives and friends in order to defame you. you may see a lawyer and take legal action against this.
