what can i do if a party refuses to give my payment and bounces his cheques three times and not answering to my phones

Why are u waiting ... send him a legal notice and file a case u/s 138 NI Act if neccessary...

you can file a complaint u/s 138 of Negotiable Instruments Act and simultaneously file a suit for recovery u/o 37 of Civil Procedure Code.

a notice is to be issued within 30 days of bouncing of cheque. if you have already issued a notice and there after deposited the cheque again your cause of action to file complaint uder 138 is gone.
Then in that case only remedy will be to file summary suit under order 37 within 3 years of the date of issuance of cheque
