Legal Question in Credit and Debt Law in India

i have not been able to pay 2 credit cards due amount since last april 2009.

i have not paid any amount after that.

it is more then 3 years, am not able to pay still. in between i had corresponded with them asking for statement of accounts in details( not monthly statements) and disagreeing with the amount outstanding. they could not deliver the same.

can the bank take any action?

Dear Sir / Madam,

You are required to regularly settle your credit card dues to the bank. In an unlikely event that you are billed for certain charge slip(s) which may not pertain to you and which have been erroneously charged to your A/c, you are required to immediately bring the same to the attention of the bank in writing within the specified time period provided in the bill (normally within 15 days from the date of billing) asking them for a clarification & reversal of the wrongly charged amount and taking an acknowledgement thereon. If there is a delay on the part of the bank to respond back to you on the wrong debits charged to your A/c before the due date, you are justified in withholding the disputed amount charged, and settling the balance due for the month to the bank and move forward.

You cannot take a stance that you will not make any payment to the bank due to certain charge slips wrongly charged to you and keep on utilizing the card till your credit limit is fully exhausted or till the bank has taken action to deactivate your card. You still remain liable to pay the bank all your legitimate dues.
