Legal Question in Credit and Debt Law in India
refusal to honor invoice
I am a freelance artist and designer
In Sept 2007 Was hired to do visuals for a publicity campaign project. At the time this project was presented to me, was informed that it was for below the line advertising (eg mousepads). Monies were not discussed at that state but later on confirmation I quoted the price for work used in that capacity. This was a verbal agreement.
By Oct 2007 however, realized that the project had been misrepresented - the work being used across several media (television, the internet, industry award shows, hoardings etc.) as the face of the campaign. I was not informed of the multiple usage, asked permissions or given credit. The work had not been paid for. On informing them I would be charging them categorically according to usage they started delay and bullying tactics. My first invoice was disregarded and they offered me payment as per my initial assessment. As the work had been used not as represented I agreed to a flat rate taking into account the various usages. They continued to use my work for over a year unpaid for at will without informing me or crediting me or paying me and continue to ignore my invoice. Please tell me what I can do. I really need help. Thank you so much for your time..

You can file a suit in the civil court for infringing your copyrights against the company.

You may not be able to claim more than the amount initially quoted by you.
