Legal Question in Credit and Debt Law in India
Sir,
the bank from where i got the credit card has made a complaint to my area police station. i am a credit card defaulter. i have not issued any cheques to them.
they had given me the credit card purely without any security.and against other credit cards i was holding. my IT return was rs 110,000/- gross since last 5 years.they gave me the card against the business as i was a partner in it . due to huge loss we closed the business. now the policeis saying to settle the dues with bank or they will file criminal case against me and put me behind bars.

the police cannot intervene in this matter and the bank has to approach the court for recovery.
this is certainly a pressure tactic to extract money. The police is for criminal offence. Non payment of Credit card dues is a civil action.
