Legal Question in Credit and Debt Law in India
Sir, I was living in Shimla when I applied for Rs. 40,000 loan from Fullerton- Shimla in Aug. 2007. After the deduction of a huge "so-called" processing charges, I got Rs. 34,213. I started repaying them Rs. 2,304 per month. Again, in Sep 2008, I applied for a loan top-up of Rs. 30,000 (even this time I got Rs. 23,654) from this blood-sucking company. They told me to hand them over new PDCs of Rs. 2,868 (from dates 06-10-2008 to 06-08-2011). As I was in hard need of money that time, I got the loan from them. I sincerely kept on paying my EMIs till Oct 2009 when I lost my job in the NGO where I was working (in Gurgaon, Haryana). Since then, I was not able to repay them and also, I could not contact them due to fear of some unknown threat. After more than 1 year of not paying the EMIs, I am now able to continue remitting the money I took from them (with some reasonable fine to be paid, if any). But very recently, I came to know from my ex-neighbours (when I used to live in Shimla at the time of getting the loan) that some policemen came to look for me. I am scared as I am an honest person and it's horrible for me even to imagine that I'll be termed as a law-offender. Please guide me thoroughly. I have served the poor people and the natural environment of India for more than 7 years. My circumstances were bad at that time when I lost my job, but my intentions were really good and honest. Please, please suggest me what to now if I want to close this bad chapter. I am able to start repaying the money (either in whole or in EMIs) to them to avoid a legal dispute. I sincerely request you to advice me what to do now. Looking forward to your reply.
With thanks, Gautam
