my partner give me the cheque against my capital invested to his company,but the cheque is bounced due to the reason that the account is closed before two years.i issued him the notice for the same for 138.
my question is
is it possible that he is escape showing himself mental retaired person.

Get the court's notice (for complaint u/s 138 of NI Act) served on him, rest of the things will be clarified in court itself.
