Legal Question in Criminal Law in India

Complaint case at pre-charge stage in the Magistrate's court. Final arguments submitted 14 months ago, thereafter there has been 33 hearings but court is not giving pre-charge verdict because one of the accused is an NRI and it seems the judge is personally inclined towards the complainant. This way the NRI accused will be held back and will come under pressure and agree to the demands of the complainant.
My question is can i ask for the case to be transfered to any other judge for fair trial?
