Legal Question in Criminal Law in India

Regarding 498A

I am a woman from Kolkata and married to a person who is a residence of Orissa.

Due to dowry torture , I filed

a F.I.R u/s 498A at a police station at Kolkata and arrest warant has been issued against my husband by the court . My husband filed a anticipatory bail petition at Kolkata Highcourt but was rejected by the HighCourt. Rejected by Kolkata Highcourt he again filed a anticipatory bail petition at Orissa Highcourt and get a Stay order to his arrest from

Orissa Highcourt.

How it is possible ? Can

any one approach another High Court and get a order if his bail petition rejected by a Highcourt ? Please suggest .

It is a process of law and depends upon facts of case.HC might have granted stay after considering all laws and after appreciating the facts of case.Approach the HC and oppose the petition filed by your husband.

Re: Regarding 498A

Anticipatory Bail application filed at a place where offence is registered. Court of the place other than place of registration of offence can only grant transit bail of one/two weeks.

You need not read both the petitions and orders thereon carefully and post correct facts for proper reply.
