Legal Question in Criminal Law in India

I had given my 2 bed room flat on rent at the rate of 8000/ month in jan 2009. At that time he had given me a cheque of rs 50000 as a form of security in case of any default. But he later stopped the cheque in march 2009 and did not pay me any rent for the month April to July and left my flat and vanished. when I presented the cheque to the bank the cheque was returned with a memo that the cheque was stopped by the drawer. What legal action can I take now.

Your right option is recovery suit. But it will go long and you also have to pay court fee.

So you can try 138 but send legal notice immedigately through an advocate within one month and give him 15 days time, but you should be aware about his adresses where is live or work or permanent resident.

u may file a complaint u/s 138 as suggested above and also file a suit for recovery u/o 37 of civil procedure code.
