Re: 138 intrument act

If you have paid the amount and have a receipt for the part payment, you may use this an evidence in your support. The same may be done during the cross examination of the complainant. Confront the complainant with the receipt. If he admits the receipt part payment is proved. or else, you would need to prove as to who wrote the receipt and who signed it, may be through an handwriting expert and your statement corroborated by the statement of witness to the receipt, if any.

Re: 138 intrument act

In your case since the matter is pending in court hence all the materials are required to be examined. The facts given by you are vague and are incomplete.Nevertheless,The evidence can be in any form to prove the transaction and that you are liable to pay the cheque amount which you have probably not paid inspite of notice.

For any other query/assistance you may call me on 9873343288

Thanks.
