Legal Question in Criminal Law in India
At about 10 p.m A and B sitting in their farm house heard some noice coming from their agricultural land. Suspecting some foul play, they informed about the some to their borther C and another person D who in turn informed E. When the three brothers A,B,C and D &E were on their way to the land , they also informed F and requesting him to join them with gun. When the reached their land , they found that some people are cutting their paddy from their land. F fired in the direction in which P,Q , R, S, T, U, V, and W were standing on the ridge of their agricultural land with deadly and sharp edged weapons. Gun fied hit P in his leg which started bleeding . Complainant party asked them to stop cutting their paddy. Hot exchanges took place . Rthrew a spear in their direction which struck C on his thigh. Complainant party retreated but they were followed by the accused persons i.e. P to W. The caught and surrounded the injured bother C and R stuck on his left leg with sword. Walso hit with sword on his back. Q assaulted him with lathi on his head.C was taken to hospital where he remained unattended for few hours and ultimately died after on week. Accused were arrested and prosecuted for various offences.
