Legal Question in Criminal Law in India

A 19 year girl had sexually intercourse regularly from Aug, 2003 till June 2006 with 25 year boy, on faith of his oral promise to will get marry,as well as they "GOT MARRY" in temple in Apr 2006,but their is no such evidence(photo) to prove that marriage, but we have his own hand written LOVE LETTERS which clearly mentioned "My Dearest WIFE (my name) " after word with minor dispute we stop talking from Oct 2006 as telling quieting the relationship,meanwhile i was called him,but he refused to talk me several time.onward the boy got better proposal by else & he got married on this 30 may 2010.with other girl.where i am still awaiting for him.

1)my question is can I take any legal action against that boy ?

2)Under Which section of IPC I can file a CASE?

3)what could be punishment/imprisonment will against boy.?

In 2003 your age was 18? what is your present age? on basis of temple marriage you can tack legal action against him. there is many sec. of IPC to register a case . you have not mentioned whether your present age is 19 or it was 19 in 2003. if your current age is 19, meaning your age in 2006 was 14 and marriage at that age is null and void. But on your complaint the person can be booked for rape as the consent was vitiated with fraud and cheating. Why did you not file the complaint between October 2006 and 2010 and claimed your rights? With all your facts, you may consult a lawyer and file your complaint as early as possible. If you have any financial difficulty engaging a lawyer, you may go to the office of Legal Aid in your district court and request a lady lawyer. This will be completely free. Be quick and do not waste further time.
