If accused is not found you can ask for forfieting his property if any or else wait till accused is found

As per Cr. P. C. the file will be kept pending to await for the accused who will remain a Proclaimed Offender till he appears in the court to face trial; The trial will begin only after the accuse appears or is produced in court.

not getting entire facts . However if u r are aggrieved by high court order then you r required to file appeal in Supreme Court . And as regards non appearance of accused u can apply for bailable non bailable warrant
