Legal Question in Criminal Law in India

i am the accused of 304a it is so happened that construction work of culvert was going on road the first half portion was constructing and another was free for traffic the all safety was done as provided by co. after completing the work we gone to our respective quarter and at the foggy night time one motorcyclist fall in the culvert and died by breaking the safety and the motar cyclist was not wearing helmet the police register fir on me was JE ON PROBATION PERIOD AND ON SUPERVISOR A CARD HOLDER THE JUDGE ORDER ONE YRS imprision my que is that are we guilty for that?
