Legal Question in Criminal Law in India
If the accused are not present at a given date in 138 NIA case, then can the petitioner or petitioner's advocate give an application to the magistrate to issue warrant against them? and will the magistrate issue warrant on the basis of such an application ?

no application is needed. bailable warrants issued first and then non bailable, in case the accused does not appear despite being served the summons.
