Legal Question in Criminal Law in India
in acriminal case there are 8 accused accused number5 was absconding so charges were framed against other 7 accused and trial started. case against accused5 was separated . examination of 20 witnesses were completed .2more witnesses are there to be examined . but now accused5 appears nbw againsta5 is withdrawn . can he be tried along with others by recalling 20 already examined witnesses/?or will he be tried separately?

If absconding accused appears or brought before the court, then generally, such accused is tried together with the other accused.
In such case, witnesses already examined may be recalled for cross-examination on behalf of the absconding accused.
