Legal Question in Criminal Law in India

in acriminal case one witness had given astatement(161) to police. he had narrated an incident which is favourable to the accused. but it is not seen in chargesheet.but that witness is no more now. can the accused ask the investigating officer about the incident during his cross?can the accused refer the 161 statement?

A police statement recorded u/s.161 Cr.P.C. can be used only for the limited purposes specified in section 162 Cr.P.C.
