Legal Question in Criminal Law in India

in acriminal casemain investigation officer is no more.the person assisted him came as a witness. in his cross he admitted that the accused a3 was not examined by him.he stated tht' it is true the witnessess statements recorded by me does not disclose any incriminating material against a3'. does it help a3.?majority of witnesses were examined by main investigating officer.important documents were not marked in his absence

there are other factors also that determine the case against an accused person., viz. witnesses, documents etc. no concrete opinion can be given in this forum as the lawyer cannot go through the f.i.r, charge sheet, evidence etc. better consult a lawyer in person.
