Legal Question in Criminal Law in India

there was acse against my husband sect 420 etc but the oerson who filed the case four yeras back does not come to the court . it is a false case. what we should do now?

Complainant appearance is must in complaint cases. You can press the court that this case is false hence personal appearance of complainant may be summoned and if he did not appear then case should be exparte and then you can file case for defamation.

in case the complainant/informant does not appear before the court despite repeated summons and in case there is corroborative evidence with the prosecution, the accused may get benefit of absence.
