Respected lawyers,

My wife sent me one beauty queen's photo and wrote her name on the photo with the help of computer DTP.She told me that its her photo.Shed sent me those photo vis email.So i have proof of emails. But completely incorrect.I came to know about it at the time of marriage.But i continued my relationship even after knowing the truth.I got married under HMA 2 years ago.

Now she has lodged 498a against me.I want to file counter case.

1)Can i file case under IT act and any other act against her for her writing her name on the photo of a model with the help of computer DTP?

2) Can she then file counter case against me for condoning her fraud and after 2 years filing case against her to take revenge from her?

1. No.

2. Yes.

You may be guilty of committing "cruelty" on her and may suffer criminal prosecution resulting into a possible jail term if you continue with this behaviour.
