Legal Question in Criminal Law in India

adultery

In August 2008, my wife has put 498A & Domestic violence and she is taking a hefty maintenance from me and is living in my own house. With help of her parents she assaulted me and dispossed me out of my own house. I came out and filed divorce with cruelty as the ground. Till 2 months back she was all alone in the house. Now, from neighbors I came to know that one man is staying in the house with her. I saw them together yesterday going in a bike. He is not her relative, but she tells to the neighbors that he is her cousin. I want to expose this in front of the court. I just want to get rid of this mess of criminal cases and take divorce. Please suggest me on what I can do? Can I file adultery or trespass against that man.

as you have already filed the divorce petiton , you should bring the facts to the notice of you lawyer. and if you has ample proofs, of adultery, you should amend the petiton.

Tresspass is possible. But for adultery extensive evidence would be required for initiating action.

In case of Adultry you have to prove or do one thing file the complaint in the police and caught her red handed alongwith her BF. Then you can amend your case.

Trespass case is possible only if your wife says that he entered the house forcibly.

Adultery needs to be proved by adducing positive evidence. Mere assumptions may not be sufficient.
