Legal Question in Criminal Law in India
By amendment in section 372 crpc, it was provided that now appeal against acquittal can be made by victim to Session court. This is effective from 31.12.2009. Can the order passed by trial court before this date and against which appeal was filed to High Court u/s 378 crpc be brought u/s 372 crpc with retrospective effect as the amendment is regarding procedural law and can �orders before 31.12.2009 of trial court� be brought back from High Court with the request to grant permission for file appeal to Session court?
