Legal Question in Criminal Law in India

Ancestral property sold without legal heirs signatures

Dear Sirs / Madam,

My grand father and my uncles joined hands together and sold an ancestral land without my signature and my fathers signature. They had sold it 5 years back without our knowledge and we came to know about this only recently.

Me and my father has a legal share in it, but they sold it without our consent or without signatures.

As per the registrar office records, the land is still not yet registered in the buyers name, but the buyer has built a house in that land.

What is the right thing to do? To file a criminal case against my grandfather and uncles or against the guy who bought it or against both?

you can file both civil and criminal case against your uncles and your grandfather.

in civil matter you can seek your share amount from your uncle, grandfather and the person who is now in the possession of the property.

in criminal matter you can file criminal complaint against all for cheating as they have sold the property without your consent and as your consent was necessary for the sale of the property.
