Thanks for the answers, But I think, I didn't ask the question right last time, which was as follows:

How long does someone have to serve the notice after filing a case under CrPC 0125? Is there any specified timeline? What if the notice is not served even after two (2) years since the case was filed?

My purpose was to find if there's any time limit to serve the notice after filing a case under this 0125. I wanted to know if the case is still valid even though the notice is not served in two years.

I didn't file the suit. It's my mother-in-law who filed the petition under CrPC 0125 in December 2010. But the notice was never served to my hubby till date. My question is ------- is the case still valid? Isn't there any deadline or time limit to serve the summon, in our legal system? If yes, how long is it? How is the court allowing her date after date every two/three months to hear the case?

This case is totally on false pretense (my mother-in-law is a rich lady with a hefty monthly income from rental properties and Bank savings) and is actually part of a huge fradulent conspiracy to cheat my husband out of his ancestral rights on his late father's property.

One may apply for time, if notice is served with short date.
