anticipatory bail application

sir,

i wantto know that whether the bail application under section 438 Cr.P.C is maintainable through Power of Attorney or not. plz provide me relevent case law

To get A.Bail, your POA is sufficient alongwith affidavit sign by you.

The requirement may be different in different States. Normally, you may need to file your own affidavit alongwith the bail application.

Only a person in detention may be represented by next friend but not an applicant who seeks anticipatory bail.

Any body can file anticipatory bail application on behalf of the accused and there is not necessary to obtain power of attorney.
