Legal Question in Criminal Law in India
Aplogies to Mr. Gupta. Please go through my questions again. I made a mistake in writing my question because of which you interpreted something else. Sorry once again. I am a working woman who is forced to live with her parents as my husband and in-laws have abandoned me..it's been more than 1.4 years. I have filed a FIR and DVA with maintenance as husband filed divorce in TIS HAZARI last year, which is still pending. Thru women cell and 498A I have got my clothes and furniture and the jewellery that was given by my parents to my in-laws and husband. I have not received some of my clothes, my furniture which is an item of dispute as they were giving me some old sofa and broken table. The jewellery given to me by my in-laws is not with me except for two silver toe-rings..Can I get it bk?IS there a provision that my in-laws can request the judge that now that they have given the jewellery given by my parents they shud not be asked to give my stridhan/jellery of their side to me. I do not want a divorce can DVA act help me saving teh marriage ..in how much time will both these cases get resolved? Please answer all questions

The time frame for decision in a case like this may not be determined; sometimes the cases keep lingering on for years together.
DVA is for your protection but it may not help to save the marriage.
You are entitled to your istridhan; you are also entitled to their criminal prosecution u/s 498-A if they had committed 'cruelty' against you.
i think i gave you the same answer last time. whether the jewelry is give by parents of the girl or parents in law, its her own jewlery and falls within the definition of stridhan. you can claim the jewelry give to you at the time of marriage by your in laws. that is your stridhan.
