Approaching Highcourt for revoking Conviction
I have been convicted by lower court under section 498A. Subsequently after clearing of misunderstanding my wife and me have come togeather cleared our misunderstanding and are now living togeather for the last 4 months. We have signed a memorandum of understanding as well. We want to approach the Highcourt to get the conciction cancelled so that our family is saved. There is no demand of dowry. We want to save our family , we have 2 grown up children. Please help.

For setting aside the conviction order made by a court you need to make an application to that particular court for the same. In this application you may mention the fact that you have settled out your differences with your wife.

firstly, you will have to file an appeal against conviction in the higher court and then seek suspension of sentence on the grounds mentioned by you. after seeking the suspension of sentence, you can file an application for discharge in the sessions court itself and in case the sessions court refuse to discharge you, you may file a petition in the high court and seek discharge.

file a petition for suspension of sentence and then file a discharge petition before the inferior court, explaining/narrating all the senario.

You may file an appeal in Sessions Court on the basis of the understanding. the court may grant you bail pending appeal.
