Legal Question in Criminal Law in India
there are8 accused in acriminal case. charge sheet says a1 along with other accused conspired nd participated in an auction. .the cheque presented was returned. the authority filed complaint sec 120b,420 etc accused1 was abscondingfrom date one.in the fir as accused there is only one person as accused. and he belongs to TTamilnadu his address is like that. but in charge sheet there are 8 accused. but in thataccused1 belongs to kerala. his address is entirely different no document to show that a1 in the fir and charge sheet is same person. there is no case that a1 gave wrong address.there is no witness alsoto say that both are the same person. charge says the person having kerala address conspired with others. but fir says person having tamilnadu address participated in auction. will the prosecution chargesstand//? name of the accused is same in both.the witnesses say they can identify the persn.as he is absconding his case is separated.will the case against others stand when trial start againstthem only?

unless a lawyer goes through the f.i.r. and the charge sheet, it would not be appropriate for him to comment on such a serious matter.
Discrepancy is address is not of much consequence.
If one want to infer something more from such discrepancy, then have all case papers vetted from your lawyer.
