whether an accused when produced by the police before the judicial magistrate first class for the offence punishable under section 332 of I.P.C can be sent to judicial custody giving time for the prosecution to file objections to the bail application of the accused

The court may deal with the bail application appropriately including accepting, adjourning or dismissing the application.

For bailable offences, court has to give bail. In non-bailable offences, court can pass such order as it may find necessary in the given circumstances.
