Legal Question in Criminal Law in India
The boss has got a complaint letter initiated and got that basis to get a case started. This finally formed the basis of prosecution of junior under the Prevention of corruption Act. Later, it was found that the date of said event in the complaint letter was wrong and hence, they got the date changed with pen but not initialled. However, we found a copy now that was issued to the accused. Can we initiate proceedings under section 340. If not, then under what section? How would this be treated by the appeal court?

as the forgery was done before the offence committed, 340 is not maintainable. a private complaint may be filed.
