Legal Question in Criminal Law in India
my brother is in jail last 70 days in false 302/201/394 case. police has not not giving charge sheet yet. can i get bail from judge court.

police are required to file chg sheet within 90 days. you can apply for his bail if after 90 days police fails to file chg sheet. However for now you can apply for bail when he is produced in court by police.

Charge sheet has to be filed within 90 days for the offences mentioned in your question before the court and if the police do no file the charge sheet with in 90 days then your brother who is languishing in jail will get bail automatically by filing a bail application before the court.
